Onsite and Excess Soil Regulations (O.Reg. 406/19), Explained and Simplified
The province of Ontario estimates that 25 million cubic meters of excess soil is excavated on an annual basis. While most of this soil is able to be reused safely, the soil can occasionally contain contaminants, which pollute surface water quality as well as the ground itself. Due to these concerns, new rules and regulations are being implemented beginning 2021 and will be phased in until 2025.
What's Changing?
Reuse Rules
As of January 1, 2021
New rules regulating how excess soil is to be handled and potentially reused will be implemented. Waste designation is also clarified
Testing, Tracking, Registration
As of January 1, 2022
New rules will be taking effect requiring specific testing and tracking to be performed on soil before it leaves site. The degree and depth of tracking will be dependent on the type and size of job. Online registration for the larger projects will be required.
Reducing Waste Soil at Reuse Sites
More regulations will be in effect, aimed at reducing the amount of waste soil that large reuse sites are holding.
Soil sampling plans, along with
soil characterization reports
will be more important than ever.
Landfilling Soil Restrictions
As of January 1. 2025
There will be restrictions on depositing clean soil at landfill sites, unless the soil is needed for cover or other beneficial functions.

Soil Management Requirements
Assessment of Past Uses
A process to identify areas of potential environmental concern, and to determine the likelihood that one or more contaminants have entered the soil.
An overarching work plan describing how excess soil will be tested, stockpiled, handled, transported and managed on the project.
A plan that outlines a sampling program to be conducted in the field, in compliance with O.Reg 406/19.
A soil report developed to outline the quality of soil onsite, and used to gain acceptance for disposal at reuse sites.
A report required to outline all the potential receiving sites the project will utilize throughout the duration of excavation.
For receiving sites accepting over 10,000 m3, this plan will outline the overall operations of your site and procedures for accepting excess soil.
